1) Scope

1.1 These General Terms and Conditions (hereinafter “GTC”) of Liebenstein GmbH (hereinafter “Seller”) apply to all contracts for the sale of goods that a consumer or entrepreneur (hereinafter “Customer”) concludes with the Seller regarding the goods presented in its online shop. The inclusion of the Customer’s own terms and conditions is hereby expressly excluded unless otherwise agreed in writing.

1.2 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.  

1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.  

2) Conclusion of Contract

2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers, but serve to submit a binding offer by the Customer.  

2.2 The Customer can submit the offer via the online order form integrated into the Seller’s online shop. After placing the selected goods in the virtual shopping cart and going through the electronic ordering process, the Customer submits a legally binding contractual offer by clicking the final order button.  

2.3 The Seller can accept the Customer’s offer within five days by:

Sending a written order confirmation or a confirmation in text form (e.g., email), whereby the receipt of the order confirmation by the Customer is decisive, or
Delivering the ordered goods, whereby the receipt of the goods by the Customer is decisive, or
Requesting payment after placing the order.
2.4 If the Seller does not accept the Customer’s offer within the aforementioned period, this shall be deemed a rejection of the offer, and the Customer is no longer bound by their order.  

2.5 Order and contract processing are usually carried out by email and automated order processing. The Customer must ensure that the email address provided by them is correct.  

3) Right of Withdrawal

3.1 Consumers are generally entitled to a right of withdrawal, the details of which can be found in the Seller’s cancellation policy.

3.2 The right of withdrawal does not apply to consumers who are not resident in a member state of the European Union at the time of the conclusion of the contract and whose sole residence and delivery address are outside the EU.  

3.3 The right of withdrawal requires that the goods are returned in perfect condition.

3.4 The Seller reserves the right to demand reasonable compensation for a reduction in the value of the goods due to improper handling.

3.5 Return Policy for Clothing
Clothing items can only be returned if they are unworn, unused, and with all original labels attached. Items with removed labels or showing signs of use are excluded from return.

4) Prices and Payment Terms

4.1 All prices in the Seller’s online shop are total prices and include statutory value-added tax. Any applicable shipping costs will be shown separately in the ordering process.

4.2 For deliveries outside the EU, additional costs such as customs duties or import taxes may apply, which are to be borne by the Customer.

4.3 Accepted payment methods are displayed in the Seller’s online shop.

5) Delivery and Shipping Terms

5.1 Delivery is made to the address provided by the Customer.

5.2 Should the Customer refuse to accept the goods or provide an incorrect delivery address, they shall bear the resulting additional costs.

5.3 For entrepreneurs, the risk of accidental loss or deterioration of the goods passes to the Customer as soon as the goods have been handed over to the shipping company. Consumers bear this risk only upon receipt of the goods.  

6) Retention of Title

Until full payment, the delivered goods remain the property of the Seller.

7) Liability for Defects (Warranty)

7.1 The statutory warranty rights apply.

7.2 Entrepreneurs must report defects within 24 hours of receiving the goods.

7.3 No liability is accepted for damage caused by improper use or modifications of the goods.

8) Limitation of Liability

8.1 The Seller is only liable for intent and gross negligence.

8.2 No liability for damage caused by improper handling by the Customer.

9) Redemption of Promotional and Gift Vouchers

9.1 Promotional vouchers can only be redeemed under the specified conditions.

9.2 Gift vouchers are valid for three years.

10) Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.  

11) Place of Jurisdiction

For entrepreneurs, the place of jurisdiction is the Seller’s registered office.

12) Alternative Dispute Resolution

12.1 The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr.  

12.2 The Seller is not obligated to participate in dispute resolution proceedings but declares its willingness to do so in individual cases.
